TWITTER CONTEST TERMS AND CONDITIONS
1. General
The Promoter of this prize draw is EA Swiss Sàrl,with registered office atPlace du Molard 8, Geneva 1204,Switzerland(hereafter referred to as “EA”) is organizing each Monday contests with prize draw on twitter website at the following address: http://www.twitter.com/EAMobileNL(hereafter referred to as the “Contest”).
The opening time and date of the each Contest is on each Monday within 2 hours of the posting time of the Tweet by EA, setting up the specificities of each Contest. Entries submitted after this time will not be considered.
2. Restrictions
This competition is open to residents in The Netherlands and in the Flanders region of Belgium, aged sixteen (16) and over only. EA can request proof that the participant is 16 years or older and can disqualify any participant under sixteen (16) who fails to provide said written proof.
Employees of EA or of its affiliates, subsidiaries, parent company, advertising or promotional agencies, as well as members of their immediate family are not eligible to enter.
3. Rules for taking part in the Contest and Contest rules
3.1. Rules for participating in the Competition
No purchase of any goods or services is necessary to be eligible for entry into this competition.
Entries submitted before the open date and/or after the close date will not be counted.
Participants from The Netherlands and from the Flanders region of Belgium must register on the following online Twitter website: http://www.twitter.com, or be connected to their user account. Once connected to its account, the Participants must follow the steps described hereunder.
3.2. Gaming rules
The Competition is in two successive parts:
1) Tweet
Participants shall, within the opening time of the Contest, and from the Contest website http://www.twitter.com/EAMobilenl,read the specific conditions of the Contest as described in EA Tweet and answer the question in EA Tweet by:
- ReTweeting EA’s message;
- Starting the message with the following hashtag:#eamobilemonday
- Give the answer to the question specified in EA’s Tweet message;
2) selection of eligible participants
Within the Participants that have answered correctly the question and have completed the above described procedure (Hereinafter the “Eligible Participants”) one (1) participant will be drawn out to constitute the winner of the prizes as detail below and in the specific conditions set out in EA’s Contest tweet message. The winner will be chosen based on their response to the question set. This will be judged on the thought and imagination put into the answer. The judge’s decision is final.
4. Prize(s)
The number of winners is restricted to the number of prizes per Contest:
§ one winner per Contest of a goodie pack, of maximum value of 50€.
The value of the prize is determined at the time these rules and regulations are being drafted and will not be subject to any debate regarding their valuation. No requests to exchange the current prizes for cash or alternatives, for any reason whatsoever, will be allowed.
Concerning the prizes, all fees regarding the delivery will be borne by EA.
Any photographs or documents regarding the prizes are not binding. EA reserves the right to substitute any of the prizes on offer for a prize of equivalent value, or of a similar nature, at any time.
EA will not be held responsible for any delay and/or losses in transit which are the fault of the postal service or carriers, nor for any partial or total damage to the prize by this type of transport or in the event that these services break down, or for any other reason.
The winners will elect their home postal address, which they will submit and confirm.
Any prizes which cannot be delivered because of a mistake or omission in the participants' details, any alteration to these details, or for any other reason, will be retained by EA.
5. Results
Winner will be contacted by a direct message to their Twitter inbox. Winners would have 7 days to answer EA’s tweet message informing them they have won, and to provide their personal address. In case the winners of the prizes cannot be traced after reasonable efforts have been made by EA or in case EA does not receive any answer within the above described limit of time, EA will retain the prize which cannot be claimed by the winner later on.

6. Privacy
By providing the required personal data by tweet messages and submitting it to EA, Participants freely and unambiguously agrees that EA shall process the personal data of Participants as provided by Participants to EA in the context of the Contests. EA shall process this personal data in a proper and careful manner and for the purpose of enabling EA to contact the winning Participants as well as for direct marketing purposes in accordance with the applicable national privacy laws.
In the event contestant does not wish for his personal data to be used for direct marketing purposes, Participants can inform EA by sending an e-mail to the following address: nlsupport@eamobile.com, or by sending written notice to the following address: Electronic Arts Nederland BV – Twitter Contests EA Mobile– 180 Beech Avenue, 1119 PS SCHIPHOL-RIJK – The Netherlands. Upon receipt EA shall cease the use of this Participants’ personal data for direct marketing purposes.
7. Disclaimer
Participants holds EA and subsidiaries harmless for any injuries, losses or damages of any kind inflicted on person or property resulting from acceptance or use of the prizes or participation in the Contests, including but not limited to use of the EA website, the Twitter website or downloading there from, late, lost or misdirected entries or e-mails, or for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in the Contests or by any human error that may occur in the processing of entries. Participation constitutes Participants’ understanding of, and full and unconditional agreement to and acceptance of the terms contained herein. EA reserves the right to disqualify any Participants that EA determines to be in violation of any term contained herein. EA’s decision not to enforce a specific provision contained herein does not constitute a waiver of that provision or the set of terms contained herein.
Notably, concerning the first prize of the Contests, Participants holds EA and subsidiaries harmless for any injuries, losses or damages of any kind inflicted on person or property resulting from the use of the Prizes.
8. Disputes
The contest is governed by Dutch law. In the event of a dispute, the decision of EA shall be final and legally binding. No correspondence will be entered into. In the event of any disputes which cannot be resolved between parties, and causes of action arising out of or connected with the Contests, such shall be resolved individually and by the Dutch court.
